EPA Soot Emission Rules Upheld.

In this case, the court denied the plaintiff's petition for review of an EPA Final Rule involving particulate matter.  The EPA adopted stricter nationwide standards for fine particulate matter in 2013, shifting the acceptable level from 15 micrograms/cubic meter to 12 micrograms/cubic meter.  The EPA rule also established additional requirements for many cities requiring the installation of air quality monitors to test for pollutants.  The court determined that the EPAs regulatory conduct was not arbitrary and capricious.  The court noted that the statutory scheme created by the Congress granted the EPA substantial discretion and that EPA's actions and explanations were at least reasonable.  The court denied the petitions for review of the EPA's Final Rule.  National Association of Manufacturers v.
