Mission Statement

 

To provide pertinent and timely information to the veterinary medical community in matters of taxation and law in association with college of veterinary medicine. This includes but is not limited to providing seminars, course work and workshops to veterinary students and those in private, public and industrial facets of veterinary medicine.

• Missouri Veterinary Medical Bd. v. Gray, No. WD75162, 2013 Mo. App. LEXIS 206 (Mo. Ct. App. Feb. 19, 2013)(non-veterinarian enjoined from providing equine tooth-floating procedure for compensation without a license; on appeal, court held state Constitution did not prohibit legislature from requiring licensure for veterinarian services; state has legitimate interest in establishing competence of individual practicing veterinary medicine and prohibition on her activities is rationally related to this purpose and not a denial of constitutional rights; court also held that distinction between non-licensed animal dentists and non-licensed animal farriers are similar enough that differentiation under statute would be illogical or irrational; trial court affirmed). 
• Baechler v. Beaunaux, No. 29476-5-III, 2012 WL 892203 (Wash. Ct. App. Mar. 8, 2012)(plaintiff brought malpractice and common law claims for death of horse after veterinarians advised plaintiff that euthanasia was only course available for cholera; veterinarians filed summary judgment based on plaintiff’s lack of expert testimony establishing requisite breach in professional standard of care; plaintiff moved for continuance to conduct depositions of veterinarians; district court denied motion for continuance and granted summary judgment motion for all claims and dismissed case; plaintiff appealed; appellate court held no abuse of discretion in denying continuance because plaintiff failed to follow procedure or establish evidence expected from delay; dismissal of claims upheld because no showing of any breach of professional care that contributed to loss).
• Scharer v. San Luis Rey Equine Hospital, Inc., No. D057707, 2012 WL 661684 (Cal. Ct. App. Feb 28, 2012)(malpractice suit against veterinarian for death of a show horse; suit brought more than one year after horse’s death; notice of intent to sue sent to veterinarian prior to expiration of statute of limitations; district court granted summary judgment to defendants holding claims for damages to animals are property damages and statute extending statute of limitations when notice of intent to sue is received did not apply; court allowed owner to amend pleadings regarding negligence to add allegations to invoke separate tolling statute; defendants filed summary judgment motions after amended petition; court granted summary judgment on all claims; appellate court affirmed, holding extension of statute of limitations only applied to “health care providers” and actions in this case based on property damage; veterinarians do not fit within statutory definition of “professional negligence”; amended petition failed because equitable tolling not available in cases where original compliant is defective).
• People v. Peters, No. 102873, 2010 N.Y. App. Div. LEXIS 9177 (N.Y. Sup. Ct. Dec. 9, 2010)(veterinarian acquired pregnant, lame mare at auction; foal born 6 weeks later and vet's employee purchased mare and foal out of concern that bet would euthanize mare due to poor health condition; mare recovered at rescue ranch, and vet indicted on single count of cruelty to animals; while court found "ample" evidence of vet's failure to provide necessary food and water to mare, there was little evidence that he failed to care for the foal; ultimately, court determined that there was insufficient evidence to support conviction of animal cruelty under state law).
